NON BENCH FITNESS BRANDED PRODUCTS

Non Bench Fitness branded products are covered by the specific companies manufacturers warranty.

EXCLUSIONS AND LIMITATIONS

Unless otherwise provided in a written agreement between Bench Fitness and the customer entitled to be covered (the “Customer” or “Owner”), the following written, express warranties, are the only express or implied warranties applicable to equipment covered in the above chart the Owner waiving any other implied warranty whether of fitness for use or otherwise. 

The Bench Built warranty is only applicable to the original purchaser and warranty is not transferrable to another person.

The Bench Built warranty is only valid for products that have been purchased directly from Bench Fitness Equipment or an authorized reseller and are fully paid for.

The Bench Built warranty does not cover used/secondhand items, former competition equipment, showroom stock, prototypes, discounted or sale items and discontinued equipment.

The Bench Built warranty is specifically limited to the repair or replacement of any defective component that is manufactured or supplied by Bench Fitness Equipment. The repair or replacement will be at the sole discretion of Bench Fitness Equipment and will be the sole remedy available under this warranty.

Normal wear and tear on components such as, but not limited to, protective high density plastic components, rubber stoppers, cables, belts, chains, coatings, upholstery (including cuts), or any other cosmetic damage resulting from regular use are not covered by this warranty.

Warranty does not cover minor cosmetic marks, knicks or variations that are deemed to be normal part of hand building strength equipment.

Damage resulting from improper assembly, inadequate maintenance, neglect, poor storage, use of equipment in an environment with excessive temperatures or moisture, or installation of other parts or components not manufactured or supplied by Bench Fitness Equipment are not covered by this warranty.

Bench Fitness Equipment holds no liability, whether under this warranty or other wise, for any special indirect, incidental, secondary, or consequential losses, damages, or expense related to fitness equipment, including but not limited to damages to persons or property.

VOID WARRANTY CONDITIONS

The Bench Built Warranty becomes invalid in the following cases:

  • Buying Bench Fitness Equipment products from an unauthorized source including but not limited to, unauthorized resellers, internet sites, dealer, resellers, private parties, and facilities.

  • Modifying equipment including removing of any branding and/or product serial numbers.

OTHER CONDITIONS TO THE WARRANTY

Failure to abide by the following conditions and limitations will void the Bench Fitness warranty.

Covered Owner must promptly notify Bench Fitness in writing of any warranty claim. Every claim must be made within the warranty period. The Owner’s notice of claim must include:

  • The name and serial number of the equipment in question;

  • The name, address, email address and phone number of the Owner;

  • The original location of the equipment and the current location of the equipment, and any other times the equipment was moved;

  • The date the issue was first notice by Owner;

  • Owner’s accurate and detailed description of alleged failure or defective condition, including when and how it occurred, and

  • Photographs of all relevant angles of the claimed issue.

Owner must promptly and accurately give written answer any questions posed by Bench Fitness.

OTHER CAVEATS AND CONDITONS

This web page document (this “Document”) sets forth all of the terms and conditions of the Bench Fitness limited, express warranty. No agent, sales representative, or other representative of Bench Fitness has any authority to make, or has made any statement, representation of warranty, either oral or written, in addition to or in elaboration of the provisions of this Document, and even if so, this Document is the agreed, sole warranty of any sort attached to the covered equipment, all prior discussions, agreements as to warranties being merged herein.

Although every commercially reasonable effort will be made to resolve the issues under warranty, if for any reason agreed resolution is not forthcoming, Owner’s sole procedural remedy will be to “Arbitration” (as defined below), Owner waiving all rights to make claim in any court or other forum in any jurisdiction.

The term “Arbitration” means all claims or disputes under this Document will be arbitrated in Thailand under the jurisdiction of the Thai Arbitration Institute with offices at 5th Floor, Criminal Court Building, Ratchadapisek Road, Chatuchak, Bangkok 10900 (the “TAI”). The place of the arbitration will be in the City of Pattaya. The language of the arbitration, of all documents, and of all correspondence shall be English. In order to be an arbitrator, the person in question must be fluent in the English language. Any arbitration award shall be accompanied by a written opinion of the arbitrator citing the law and facts. Unless otherwise mutually agreed in writing by the parties to the arbitration (the “Parties”) agree as follows:

  • The number of arbitrators will be one;
  • The Parties will be permitted to offer evidence orally and in writing and in documents;
  • The Parties will be permitted to make their arguments orally;
  • The arbitrators may not appoint experts unless both Parties agree in writing;
  • The fees of the TAI will be shared equally by the Parties and if one Party makes a payment in full, the other will promptly reimburse the initial payor 50%;
  • If there is one arbitrator, the compensation and permitted expenses of the arbitrator will be shared equally by the Parties;
  • If the Parties agree in writing to there being 3 arbitrators, each Party will pay the compensation and permitted expenses of the arbitrator it selects and the compensation and permitted expenses of the 3rd arbitrator will be shared equally by the Parties; and
  • Each Party shall pay its owns expenses and the remuneration and expenses of its counsel and consultants and witnesses it calls;
  • Except as provided in this Section, the provisions of the Thai Arbitration Act B.E. 2545 and the rules of the TAI will apply; and
  • The sole law used in the Arbitration will be the law of the Kingdom of Thailand except to so called choice of law rules.

The law of the Bench Fitness warranty is the law of the Kingdom of Thailand except to so called choice of law rules.
The Bench Fitness warranty may not be changed except in a writing signed by Bench Fitness.

PRODUCTION AND SHIPPING TIME

If your equipment is made to order, once you place an order, and you have approved your designs and logos, our manufacturing facility will begin crafting your product with the utmost care and precision. Please note that the production time for your order is approximately 4 weeks after you have approved designs.

For international orders, in addition to the production time, please allow an additional 4-6 weeks for shipping to your location. We work with reputable international shipping carriers to ensure your order arrives safely and promptly.

DAMAGED AND LOST ITEMS

In the unlikely event that your order arrives damaged or is lost during transit, please contact our customer support team immediately. We will work with the shipping carrier to investigate the issue and provide a suitable resolution, which may include a replacement, refund or shipping carrier claim.
